The vast majority of my clients with child custody and visitation issues are loving and caring parents who want to do what is best for their children, but discussion of best interests can be a contentious and sensitive matter. The Basics of Child Custody

Arizona family law judges are required to decide child custody issues according to the best interests of the children involved, and they must make findings of fact that demonstrate a careful consideration of the factors that Arizona law deems most important including the wishes and preferences of the parents, the preferences of the child, the mental and physical health of all persons concerned, which parent has served as the primary caregiver and which parent is likely to provide the other parent with meaningful contact with the child.

Sometimes divorcing parents are confused about the legal terminology of custody law. I can fully explain your rights in helping you and the other parent shape a workable, flexible, and creative custody agreement that serves the interests of both the children and the adults. I am experienced in negotiating work schedules, school and activities, family holidays, vacations, weekend custody, and any other obstacles to agreement.

Mediation Approach

Parents are free to make their own custody and visitation arrangements, or through Conciliation Services, a mediation service for parents provided by the Arizona Superior Courts. An amicable agreement is best for all, avoiding arbitrary decisions by a judge who is unfamiliar with the family dynamics and needs of the individuals. I will assist you with scheduling the appointment and preparing you for the conciliation session.

However, sometimes one party cannot or will not accommodate the other parent’s wishes in this emotionally charged process. In these cases, you can feel confident that I will provide aggressive protection of your rights and interests.

Modifications of Child Custody and Visitation

When circumstances change, such as altered work schedules, responsibilities to a new family, or one parent moving away, I represent clients in revisiting the child custody agreement. I will adamantly protect your rights to ensure you have contact and access to your children, and assure that the kids’ best interests are addressed by the court and opposing counsel.
